General conditions of sale for activities

Article 1 – Definitions and Scope

1.1. WAVRE INDOOR KARTING, abbreviated as WIK, refers to GDM Organisation SRL – BE 0635.946.747, whose headquarters are located at 117 Boulevard de l’Europe, 1300 Wavre.

1.2. The Client refers to the individual who has made a reservation with WAVRE INDOOR KARTING via the website www.wik-karting.be or via email booking service at info@wik-karting.be or directly on-site.

1.3. By making a reservation, the Client acknowledges having read and accepted these general terms and conditions of sale. The Client declares having full legal capacity to commit to these terms and confirms having obtained all necessary information via the website or the reservation service. Any reservation implies the Client’s full and unconditional acceptance of these terms, to the exclusion of any other document established in writing between the Client and WAVRE INDOOR KARTING.

Article 2 – Reservation

2.1 The Client acknowledges having reviewed all the information regarding the products and services offered by WIK via the website www.wik-karting.be and having requested and obtained any necessary and/or additional information to make their reservation via info@wik-karting.be or by phone. The Client certifies the truthfulness and accuracy of the information provided. The Client acknowledges being fully aware and having all the necessary information to proceed with the reservation. It is important to emphasize that the photographs are for illustrative purposes. While the aim is to give an accurate overview, variations may occur.

2.2 The Client is solely responsible for their choice of services and their suitability to their needs, so WIK cannot be held responsible in this regard.

2.3 WIK enters into partnership contracts with third-party leisure sites. When purchasing on a partner’s website, the Client receives a secure and unique code. This code can be used to make a reservation via www.wik-karting.be. In addition to these terms, it is specified that the partners are responsible for promoting offers through their own communication channels.

Article 3 – Payment

3.1 All activity reservations must be made online via www.wik-karting.be. The Client pays a proforma deposit invoice representing 100% of the total amount including VAT. The final invoice must be requested on the day of the activity at the location. We remind you that the membership card is mandatory for all drivers. This card is valid for 365 days from activation and is available for purchase only at the counter.

3.2 The deposit invoice is a proforma invoice. It is reminded that the VAT mentioned on the deposit invoice is for informational purposes. The deposit is validated on the day of the activity via a receipt. The Client can request a final invoice during checkout on the day of the activity. No requests for changes to product descriptions will be accepted.

3.3 For online payments, Bancontact cards and credit cards are accepted. For counter payments, Bancontact cards, VISA, Sodexo – Cadeau Pass, Edenred – Ticket Compliments, Edenred – Ticket Sport & Culture, and Edenred – Chèque Consommation are accepted. We remind you that American Express cards are not accepted.

3.4 The order is considered final upon receipt of confirmation by email. This document summarizes the characteristics of the services and/or products reserved by the Client via the website or reservation service. Without confirmation, WIK will not be held responsible for the cancellation of the order, subject to availability.

Article 4 – Modification(s), Delay and Refund

4.1 These general terms and conditions cancel and replace all previous correspondence exchanged between the parties. Any requests for modifications must be made by email via info@wik-karting.be or by phone, and it is the responsibility of WIK to acknowledge receipt of the request, assess whether it can be partially or fully addressed, and send a confirmation by email.

4.2 Modification requests are valid only for reservations and not for ticket product purchases. Modifications include, but are not limited to, cancellation of the reservation, changes to the date, time, number of people, or product change in the reservation.

4.3 WAVRE INDOOR KARTING accepts modification requests under specific conditions:

  • More than 3 full days before the reservation date, modifications are accepted. Refunds will be made to the Client’s wallet. The Client will be refunded to their virtual wallet if they request a bank transfer refund.
  • Between 3 full days and 24 hours before the reservation date, modifications are accepted. Refunds will be made to the Client’s wallet. The amount can be used for the purchase of products and/or services at WIK within 365 days following the wallet recharge.
  • Less than 24 hours before the reservation, no modifications are allowed. No refunds will be processed except in exceptional cases defined in Article 4.5.
  • No-shows, defined as confirmed reservations not canceled, will be entirely the responsibility of the Client, with no refund possible.

4.4 We remind you that the Client must arrive 30 minutes before the reservation time to sign the liability waiver and attend the safety briefing. WIK reserves the right to treat any delay, meaning failure to arrive at the scheduled time, as a cancellation. If, despite all efforts by WIK to find a solution, the delay prevents the activity from being carried out, no refund will be granted.

4.5 Exceptional situations for modification at the Client’s request include, but are not limited to, a physical inability to perform the activity or illness. WIK is responsible for cancellations that occur due to the inability to provide services, such as in cases of flooding on the track, power outages, etc.

Article 5 – Liability Waiver and Accidents

5.1 In accordance with WIK rules, any Client wishing to access the track as a driver must sign a liability waiver. Drivers who refuse to sign the waiver will not be allowed to access the track, and such refusal will be considered a cancellation of the reservation. No refunds will be accepted.

5.2 In accordance with the liability waiver, WIK cannot be held responsible for accidents caused by the Client or a third-party driver, unless they result from a technical defect. It is imperative that the Client immediately report any technical defect by returning to the pit. If the Client does not return to the pit before the end of the session, WIK will consider that there was no technical defect. In cases where WIK is responsible, a full refund of the activity will be issued, followed by a claim with the insurance.

5.3 It is the Client’s responsibility to take care of their personal belongings by placing them in the secure lockers, which are equipped with a security code and provided free of charge by WIK. WIK declines any responsibility for damage or theft of these items.

Article 6 – Respect of the Establishment’s Rules

6.1 WIK reserves the right to refuse access to any person who may harm the establishment or its image.

6.2 The Client agrees to comply with all instructions and regulations of WIK. The Client will not disrupt the operation of WIK or cause physical or moral harm to any persons present.

6.3 Any behavior contrary to good morals or public order will result in the immediate expulsion of the Client from the establishment, without compensation or refund if payment has already been made. Behaviors such as, but not limited to, disrupting the proper functioning of WIK, harming its reputation or security, disturbing other clients, being intoxicated, or acts of vandalism, are considered contrary to good morals.

Article 7 – Force Majeure

7.1 The obligations contained herein will not be applicable or will be suspended if their execution becomes impossible due to a force majeure event, such as, but not limited to: acts of public authority, hostilities, war, natural disaster, fire, flood, or pandemic (only in the case of government measures prohibiting the activity). WIK will make every effort to prevent or reduce the effects of non-performance of the activity caused by a force majeure event: the party wishing to invoke a force majeure event must immediately notify the other party, otherwise, they will not be relieved of their responsibility.

7.2 In the event of force majeure, the Client will be fully refunded for the deposit.

Article 8 – Complaints and Competent Courts

8.1 Complaints related to the non-performance or improper performance of the activity must be submitted in writing to WIK within 3 clear days after the date of the activity to the reservation service via info@wik-karting.be.

8.2 Any dispute between the parties related to the interpretation or execution of the activity that could not be resolved amicably will be brought before the French-speaking Commercial Court of Brabant-Wallon.
